At the 7th regular session held on April 17 this year, the High Judical Council adopted the Rulebook on the Evaluation of Judges and Presidents of Courts. The Rulebook revises important area that deserves a detailed analysis, primarily from the aspect of practical application and consequences that may arise from the proposed solutions, which significantly affect judicial independence and the improvement of the work of the courts with the aim of strengthening trust in the work of judges.
With that in mind, CEPRIS has formed a working group with the aim of creating a model of the rulebook governing this area. The Model Rulebook on Criteria, Indicators, Methods and Procedures for Evaluating the Work of Judges and Presidents of Courts is the result of the work of Ana Stamenić, judge of the High Court in Novi Sad and president of the special department for combating corruption, together with colleagues – Miodrag Jovanović, full professor of the Department of Theory, Sociology and philosophy of law from the Faculty of Law of the University of Belgrade and Nataša Stojadinović, lawyer in Belgrade. The model contains concrete directions for the purpose of evaluating the work of judges – assessment, maintenance and improvement of the quality of work, while respecting the independence of the judge in order to strengthen public trust in the work of the judge and the court.
In relation to the Rulebook on the Evaluation of Judges and Presidents of Courts adopted by the High Judical Council, the CEPRIS Model contains more transparent and precise terminology, and thus contains clearly defined criteria and indicators – data sources, which contributes to a simple, comprehensible and equal application for all judges and presidents of courts. The High Judical Council decided that the indicators contain descriptive terms, without specifying the data sources used to determine the indicators. CEPRIS is of the opinion that the imprecise definition of indicators for prescribed criteria leads to confusion and the impossibility of measurable, objective and clear indicators of the work of judges and court presidents.
